Paperwork for selling a used car, bike or scooter

Most used vehicles in India are sold person to person: to a neighbour, a colleague, someone who answered your ad. The money changes hands, the keys change hands, and the RC transfer happens a few days or weeks later. That gap is where problems start: a traffic challan, an accident or a police case in those days, and nobody is sure who had the vehicle. A short written sale letter and a delivery note with the exact date and time of handover settle that between buyer and seller.

This generator writes three documents, in English or Hindi:

  • Sale agreement (sale letter): seller and buyer details, the full vehicle details, price and payment, loan status, the handover, who is responsible for what and when, the RTO transfer step, the documents handed over, signatures and witnesses.
  • Delivery note: a one-page note, signed by both, that the vehicle, keys and papers were handed over at a stated date and time against full payment.
  • Advance (token) receipt: when the buyer pays a token amount first, with the agreed price, the balance and the date it is due, and what happens to the advance if the deal falls through.

How to use the vehicle sale letter generator

  1. Choose the document and language.
  2. Vehicle. Car, motorcycle, scooter or other. Copy the registration number, make and model, year, colour, chassis number and engine number from the RC, and add the odometer reading and insurance details.
  3. Loan. Say whether the vehicle has no loan, a loan that is closed (NOC handed over), or a running loan the seller will close by a date.
  4. Seller and buyer. Full names, father's or husband's name, addresses, mobile numbers and an optional ID. The seller should be the owner named in the RC.
  5. Price and payment. The sale price, how it was paid and the transaction or cheque number. For an advance, the token amount, the date and when the balance is due.
  6. Handover and transfer. The date, time and place of handover, the documents and keys handed over, who will apply for the RTO transfer and who pays the fee.
  7. Sign. Add witnesses if you have them, print two copies, and both sign each copy. Each of you keeps one.

What to check before you sign

CheckWhy
Chassis and engine numbers on the vehicle match the RCProves it is the same vehicle; the RTO checks them during transfer
Seller's name and address match the RCOnly the registered owner can sign Forms 29 and 30
"Hypothecated to" on the RCIf a bank is named, you need the financier's NOC and Form 35 to remove it
Pending challansCheck on the state's e-challan or Parivahan site so the seller clears them before handover
Insurance and PUCValid insurance is needed to drive; the buyer should transfer the policy or take a new one
Payment receivedFor bank transfers and UPI, the seller confirms the money arrived before handing over the keys

The RTO transfer: Forms 29 and 30

A sale letter, however detailed, does not change the owner in government records. The transfer of ownership is recorded by the registering authority (RTO) on an application with Form 29 (notice of transfer of ownership) and Form 30 (the application for transfer of ownership), signed by both parties, with the RC, insurance, PUC certificate and the fee. Most states now take the application online on Parivahan (Vahan citizen services), and you then submit the papers as your RTO asks. If the vehicle is moving to another state, an NOC from the original RTO is needed too. The Puducherry Transport Department's page is one example of the documents an RTO asks for; check your own state's list.

There are time limits. As the Supreme Court explained in Prakash Chand Daga v. Saveta Sharma (2018), section 50 of the Motor Vehicles Act, 1988 asks the seller to report the transfer within 14 days (longer when the vehicle is registered in another state) and the buyer within 30 days. The same judgment held that the person whose name stays in the RTO records can still be liable to a third person, for example in an accident claim, even after selling the vehicle. That is the real reason to finish the transfer quickly: the clause in your sale letter protects you against the buyer, but not against everyone else.

Handover time and responsibility

The delivery note and the agreement both record the date and time the vehicle changed hands, and say that from that moment the buyer is responsible for challans, accidents and legal cases arising from its use, and the seller for everything before. Write the actual time, not a round number. If a challan later arrives for an earlier date, the seller pays it; for a later date, the buyer does. Both of you should keep photos of the odometer, the vehicle and the signed papers from the day of handover.

Tips and common mistakes

  • Don't hand over the RC before the money arrives. For cheques, wait for the cheque to clear.
  • Sign Forms 29 and 30 at the same time as the sale letter, so the buyer can apply at once. The seller should keep a copy of the signed forms.
  • Give the buyer every key, the service book and any warranty papers, and list them in the documents section.
  • Stamp paper and notary. Many people sign the sale letter on plain paper or low-value stamp paper and have it notarised. Practice differs by state; a local notary can tell you what is usual.
  • Cancel your FASTag or move it and update the insurance, so the old owner's account and policy are not used for the sold vehicle.

Need a simple money receipt instead? Use the receipt maker, which also does advance receipts. For an affidavit or an authority letter for the RTO, try the affidavit generator and the authority letter generator.

Frequently asked questions

Does a sale letter transfer ownership of the vehicle?

No. The sale letter records the deal between you. The owner's name changes only when the registering authority (RTO) records the transfer, which is done with Forms 29 and 30, online through Vahan in most states. Until then the RTO records still show the seller as the owner.

What is the time limit for transferring a vehicle after sale?

Section 50 of the Motor Vehicles Act, 1988 asks the seller to report the transfer within 14 days (with a longer period, 45 days, for a vehicle registered in another state), and the buyer to report it within 30 days. Do it as soon as you can.

Why write the time of handover?

So both of you know who had the vehicle when a challan, accident or police case happened. The delivery note records the date and time, and says the buyer is responsible from then. Keep in mind that, towards other people, the owner on RTO record can still be held liable until the transfer is recorded (Supreme Court, 2018).

What are Form 29 and Form 30?

Form 29 is the notice of transfer of ownership; Form 30 is the application for the transfer of ownership. Both are signed by the seller and the buyer and submitted to the RTO, with the RC, insurance, PUC and the fee. If the vehicle had a loan, the financier's NOC and Form 35 are needed too.

What if the vehicle still has a loan on it?

The RC shows the financier until the loan is closed. Choose 'Loan running, seller will close it' and set a date: the agreement says the seller will repay the loan and hand over the financier's NOC and Form 35 by then.

Does a vehicle sale letter need stamp paper or a notary?

Many people sign it on plain paper or low-value stamp paper and get it notarised, but practice differs by state. Ask a local notary. The tool can leave blank space at the top for stamp paper.

Can I make the sale letter in Hindi?

Yes. Choose हिन्दी: the agreement, delivery note and advance receipt all have Hindi versions, with the handover time written the Hindi way, for example शाम 5:30 बजे.
