A complete gift deed draft from one form
Families in India often gift a house to a son or daughter, put a flat in a spouse's name, give money to a child to buy a home, or pass on gold jewellery. A gift deed records that gift in writing: who gave what to whom, that nothing was paid for it, and that the person receiving it accepted it. This tool fills every name, amount and description into the right places.
It has three formats: a house, flat or land; money paid by bank transfer, cheque or cash; and movable things such as gold, a vehicle or shares. It handles one or two donors (for example a husband and wife who own a flat jointly), one or two donees, and a minor donee who accepts through a guardian. You get numbered clauses, a schedule, two witness blocks and a blank area at the top for the stamp paper, in English or Hindi, as a PDF or Word file.
How to use it
- Choose what is gifted: house / flat / land, money, or gold, vehicle and shares.
- Enter the donor and the donee: full names as on ID documents, father's or husband's name, age, address and, if you like, PAN. Pick the relation, such as son, daughter or wife.
- Describe the gift. For property, give the description, address, khasra or survey number, area, boundaries and how the donor got it. For money, give the amount, how it was paid and the bank reference. For gold or a vehicle, list each item so it can be identified.
- Add the witnesses, the place and the date, and choose how much blank space to leave at the top for the stamp paper.
- Read the draft in the live preview, change any wording you need, and download the PDF or Word file.
What the law says about gifts
Gifts of property are covered by Chapter VII of the Transfer of Property Act, 1882. The points that matter most for a gift deed are:
- What a gift is (section 122): a transfer of existing movable or immovable property, made voluntarily and without consideration, and accepted by or on behalf of the donee. The acceptance must happen during the donor's lifetime. If the donee dies before accepting, the gift is void. That is why the deed has an acceptance clause and the donee signs it.
- How it is made (section 123): a gift of immovable property must be made by a registered instrument signed by or on behalf of the donor and attested by at least two witnesses. A gift of movable property can be made either by a registered instrument or by delivery.
- Future property (section 124): a gift of property the donor doesn't own yet is void as to that part. Gift only what the donor owns today.
- Taking a gift back (section 126): the parties can agree that a gift will be suspended or revoked on a specified event that doesn't depend on the donor's will. A gift that the donor may revoke at will is void to that extent. Otherwise, a gift can only be set aside in cases where a contract could be rescinded, such as fraud.
- Muslim law (section 129): this chapter doesn't affect any rule of Muslim law, so a gift (hiba) made under Muslim law follows its own rules. Ask a lawyer if this applies to you.
The three formats
| Format | Typical use | What it adds |
|---|---|---|
| House / flat / land | Parent to child, between spouses or siblings | How the donor got the property, possession, no-encumbrance declaration, mutation, taxes, market value and a schedule with boundaries |
| Money | Money for a home, education or a wedding | Amount in figures and words, bank transfer or cheque details, a statement that it isn't a loan |
| Gold, vehicle, shares | Jewellery, a car or shares given in the family | A schedule of items, delivery today, and the transfer of any registered item into the donee's name |
Gifts and income tax
The Income-tax Act, 2025 applies from 1 April 2026. Section 92(2)(m) taxes money or property received without consideration when its total value in a tax year is more than ₹50,000; the whole amount, not just the excess, becomes income from other sources. Section 92(3) lists exceptions. The main ones are gifts from a relative, gifts received on the occasion of your marriage, and receipts under a will or by inheritance.
Section 92(5)(g) defines "relative" for an individual as the spouse; brother or sister; brother or sister of the spouse; brother or sister of either parent; any lineal ascendant or descendant (maternal and paternal); any lineal ascendant or descendant of the spouse; and the spouses of all of these. A gift from your father, mother, grandparent, spouse, sibling, child or grandchild therefore isn't taxed in your hands. A gift from a friend or a cousin can be.
Two more rules are worth knowing. Section 186 says no person may receive ₹2,00,000 or more in cash from one person in a day, in one transaction or for one event, except through a bank. So give large money gifts by bank transfer or account payee cheque. And keep the bank statement with the gift deed: it shows where the money came from.
Stamp duty and registration
Stamp duty and the registration fee on a gift deed are set by each state, and the rates and any family concessions change from time to time. This tool doesn't show an amount, because a wrong figure could cost you money. Check your state's registration and stamps department website, ask at the sub-registrar's office, or ask a lawyer. Then print the deed on stamp paper of that value, or attach the e-stamp certificate, and present it for registration at the sub-registrar's office for the area where the property is.
Tips before you sign
- Copy the property description and boundaries from the donor's own title deed, and quote that deed's registration number.
- Write names exactly as they appear on Aadhaar, PAN and the title documents.
- If the property is mortgaged, say so in the encumbrance field and talk to the lender first.
- After registration, apply for mutation in the municipal or revenue records so property tax bills come in the donee's name.
This is a draft format, not legal advice. Stamp duty and registration rules differ by state, so check with a lawyer, a notary or the sub-registrar before you sign. Nothing you type leaves your browser: there is no upload, no sign-up and no watermark. Passing property on after your death is different: for that, see the will generator.

Frequently asked questions
Does a gift deed of a house or land have to be registered?
Yes. Section 123 of the Transfer of Property Act, 1882 says a gift of immovable property must be made by a registered instrument, signed by or on behalf of the donor and attested by at least two witnesses. An unregistered gift deed of a house, flat or land does not transfer it.
Does a gift of money or gold need registration?
No. For movable property, section 123 allows the gift to be made either by a registered instrument or simply by delivery. A written gift deed is still useful as a record, especially to show the source of money in income-tax matters.
Is a gift from my father or mother taxable?
Gifts from a relative are not taxed as income. Under section 92(3) of the Income-tax Act, 2025, the gift rules in section 92(2)(m) don't apply to money or property received from a relative, and section 92(5)(g) defines relative. Parents, spouse, brothers, sisters and children are all included.
When is a gift from a non-relative taxed?
If the money or property you receive without consideration from non-relatives in a tax year is worth more than ₹50,000 in total, the whole amount is taxed as income from other sources (section 92(2)(m), Income-tax Act, 2025). Gifts received on your marriage or under a will are exempt.
Can a gift deed be cancelled later?
Only in limited cases. Section 126 of the Transfer of Property Act lets the donor and donee agree that the gift will be suspended or revoked if a specified event happens that doesn't depend on the donor's will, and a gift can be set aside where a contract could be, such as for fraud. Otherwise a gift cannot be revoked. Ask a lawyer before you add any condition.
How much stamp duty is payable on a gift deed?
Each state sets its own stamp duty and registration fee on gift deeds, and some charge different rates for family members. This tool doesn't calculate it. Check your state's registration and stamps department website, the sub-registrar's office or a lawyer.
Can I make a gift deed in Hindi?
Yes. Choose हिन्दी and the whole deed, the schedule and the witness block are written as a दान पत्र, with amounts in Hindi words. Hindi prints correctly in the PDF and Word file.
Can a minor receive a gift?
Yes. Section 122 allows the gift to be accepted by or on behalf of the donee, so a parent or guardian can accept it for a minor. Choose “Yes” for a minor donee and enter the guardian; the deed then says the gift is accepted through the guardian.
