Selling a used bike the safe way

Second-hand motorcycles and scooters change hands every day across India, often between friends, colleagues and neighbours, and often with nothing more than a handshake. The trouble comes later: an e-challan from a traffic camera lands on the old owner's phone, or the buyer is in an accident before the RC is transferred. A one-page bike sale agreement, signed by both sides with the exact time of handover, is the simplest protection.

The generator above is set to the sale agreement for a motorcycle. Switch to Scooter if that's what you're selling, or to the delivery note or advance receipt.

What to copy from the RC

Keep the bike's RC (smart card or the digital RC in DigiLocker or mParivahan) next to you and copy these exactly:

  • Registration number, such as MH 12 AB 1234.
  • Make and model, such as Hero Splendor Plus or Honda Activa 6G.
  • Chassis number and engine number. These identify the bike for the RTO, the insurer and the police. Check them against the numbers stamped on the frame and engine.
  • Year of manufacture and colour.
  • The "hypothecated to" line, if any. A bike bought on a loan stays hypothecated to the lender until the loan is closed and the entry is removed from the RC.

Price, payment and handover

Write the agreed price; the amount in words is added for you. For UPI or bank transfer, add the transaction number. For cash, both sides should count it in front of each other. Then write the date and time the bike, keys and papers changed hands. The agreement says that from that moment the buyer is responsible for challans, accidents and cases arising from riding it, and the seller for anything before.

Papers to hand over with a bike

The default list covers the original RC, the insurance policy, the PUC certificate, the service book and bills, and two keys. Edit it to match what you are actually giving: some bikes have one key, some owners have lost the service book. A list both of you sign avoids "you never gave me the second key" later.

Finish the RC transfer

The agreement records the deal between you, but the owner's name in the RTO records changes only after the transfer is applied for with Forms 29 and 30 and approved. Many states take this online on Parivahan's Vahan services. Sign the forms when you sign the agreement, and apply quickly: until the transfer is recorded, the seller is still the owner on record, and the law sets time limits for reporting the transfer. If the bike had a loan, the buyer will also need the lender's NOC and Form 35.

Quick checks before you sign

  • Search the bike's number on your state's e-challan or Parivahan site for pending challans, and settle them.
  • Make sure the seller is the person named in the RC.
  • Take photos of the odometer, the bike and both of you with the signed agreement.
  • Each of you keeps one signed copy.

Frequently asked questions

What details go into a bike sale agreement?

The seller and buyer with addresses, the bike's registration number, make and model, year, chassis and engine numbers, the price and how it was paid, the date and time of handover, the documents and keys handed over, and who applies for the RTO transfer.

Where do I find the chassis and engine numbers?

On the RC (registration certificate). Check that they match the numbers stamped on the bike's frame and engine before you sign.

Who applies for the RC transfer when a bike is sold?

Usually the buyer, with Forms 29 and 30 signed by both. The agreement lets you choose who applies and who pays the fee. Until the RTO records the transfer, the seller is still shown as the owner.

Can I make a scooter sale agreement with this?

Yes. Choose Scooter under Vehicle and the agreement says scooter throughout. Car and other vehicles work the same way.
