A complete rent agreement draft in a few minutes
Most rentals in India start with a written agreement: an 11-month rent agreement for a flat, a leave and licence agreement in Maharashtra, or a commercial agreement for a shop or office. Owners and tenants usually get one from a broker or a typist and spend time correcting names, dates and amounts. This tool builds the full draft from a form, so every name, figure and date is filled in the right places and stays consistent.
It handles up to 3 owners and 4 tenants, writes the rent and deposit in figures and words, works out the end date, and adds only the clauses you choose: lock-in, rent increase on renewal, maintenance, pets, subletting and police verification. You also get a witness block, an inventory annexure and a blank area at the top for the stamp paper. Choose English or हिन्दी, then download a PDF or Word file.
Which agreement to choose
- Residential (11 months): the usual rent agreement for a flat, house or room, with the owner called the Landlord and the occupant the Tenant.
- Leave and licence: the owner (Licensor) only permits the occupant (Licensee) to use the premises, and the agreement says it creates no tenancy. This form is common in Maharashtra and is used elsewhere too.
- Shop / office: for commercial premises. It names the business, makes the tenant responsible for business licences, and lets you add a line on GST on rent. Pets and the residential-use clause are left out.
All three share the same form, so you can switch between them and compare the drafts without retyping anything.
How to use it
- Choose the agreement: residential (11 months), leave and licence, or shop / office.
- Add the parties. Pick the number of owners and tenants and fill in each person's name, relation, address and, if you like, an ID such as PAN.
- Describe the property: what is being let ("a 2 BHK flat on the third floor"), its full address, the furnishing, and the items handed over, one per line, for the annexure.
- Set the term and money: start date, months, monthly rent, the day it is due, how it is paid, the deposit, maintenance and who pays electricity and water. Add the meter reading on the day you move in.
- Choose the rules: lock-in, notice period, rent increase on renewal, pets, subletting, police verification, who pays the stamp duty, and any clauses of your own.
- Add witnesses and the signing place, set the stamp-paper space, read the draft and download it.
What the agreement covers
| Part | What it says |
|---|---|
| Parties | Every owner and tenant with relation and address, called the Landlord and Tenant (or Licensor and Licensee) |
| Premises | What is let and where, and why (residential use, or the business to be run) |
| Term | Start and end dates; renewal only by written consent |
| Rent and deposit | Amount in figures and words, due date, payment method, interest-free refundable deposit and what may be deducted |
| Bills | Maintenance, electricity and water, opening meter reading |
| Rules | Lock-in, notice, rent increase, use, subletting, pets, repairs, alterations, inspection, police verification |
| Handover | Vacant possession at the end, with the annexure items, subject to normal wear and tear |
| Signatures | Owners, tenants and two witnesses; the annexure is signed separately |
Registration, stamp duty and the 11-month rule
Under section 17(1)(d) of the Registration Act, 1908, leases of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent must be registered (the Supreme Court restated this in a 2020 judgment). That is why so many agreements run for 11 months. You can still register a shorter agreement, and doing so can help if there is ever a dispute.
States add their own rules. In Maharashtra, leave and licence agreements must be registered whatever the term, and the state's registration department runs online registration of leave and licence agreements. Other states have their own procedures and rent laws.
Stamp duty is set by each state and often depends on the rent, deposit and term. This tool doesn't calculate it, because a wrong figure could cost you. Check your state's registration and stamps department website, ask the e-stamp vendor, or ask a lawyer. Then print the agreement on stamp paper of that value or attach the e-stamp certificate.
The Model Tenancy Act, 2021 is a model law that states may adopt. Its text caps the deposit at two months' rent for homes and six months' for other premises, but only where a state has adopted it. Check your state's law before you settle the deposit.
Hindi agreements
Choose हिन्दी and the whole agreement, including the clauses, the witness block and the annexure, is written in Hindi as a किरायानामा. Rent and deposit amounts are written in Hindi words as well as figures. Names and addresses can be typed in Hindi or left in English. Hindi lines are drawn with a proper Devanagari font in the PDF, so matras and joined letters print correctly.
Tips before you sign
- Copy names exactly as on ID documents, and use the full property address, including the floor and flat number.
- Walk through the house together and list the items in the annexure, with counts. It avoids arguments about the deposit later.
- Note the electricity meter reading on the day the tenant moves in.
- Pay rent through a bank or UPI, or take a signed receipt. Our rent receipt generator makes monthly receipts for HRA claims.
- Every owner, tenant and both witnesses should sign each page. Keep one original each.
- Complete tenant police verification where your city requires it.
This is a draft format, not legal advice. Read every clause, change anything that doesn't match your deal, and ask a lawyer for anything unusual. Nothing you type leaves your browser: no upload, no sign-up and no watermark. Need a sworn statement? Try the affidavit generator.

Frequently asked questions
Why are rent agreements made for 11 months?
Under section 17(1)(d) of the Registration Act, 1908, a lease from year to year, for a term of more than one year, or reserving a yearly rent must be registered. An 11-month agreement stays below that, so many people use it to avoid compulsory registration. Some state laws differ, so check yours.
Does an 11-month rent agreement need to be registered?
Not under the central Registration Act alone, but some states have their own rules. In Maharashtra, for example, leave and licence agreements are registered whatever the term, and the state's registration department offers online registration. Check your state's registration and stamps department.
How much stamp duty is payable on a rent agreement?
It is set by each state, often based on the rent, deposit and term, and rates change. This tool does not calculate it. Use your state's registration and stamps department website, the e-stamp vendor or a lawyer to find the exact amount.
What is the difference between a rent agreement and a leave and licence agreement?
A leave and licence agreement only permits the licensee to use the premises; it says it creates no tenancy or interest in the property. It is common in Maharashtra. A rent agreement creates a tenancy. The tool has both, plus a commercial shop/office format.
Can I add more than one owner or tenant?
Yes. Choose up to 3 owners and 4 tenants. Each gets a line in the parties section and a signature line at the end. For a firm, write its name with the person signing, such as 'Sharma Traders, through its proprietor Rakesh Sharma'.
How much security deposit can a landlord take?
It depends on your state's tenancy law and on what you agree. The Model Tenancy Act, 2021 suggests a cap of two months' rent for homes and six months' for non-residential premises, but it applies only in states that adopt it. Write the agreed amount in the deposit field.
Can I make the rent agreement in Hindi?
Yes. Choose हिन्दी for a full Hindi किरायानामा with all clauses, witnesses and the annexure. Amounts are written in Hindi words too. Hindi prints correctly in the PDF and Word file.
Is this agreement legally valid?
It is a draft that you print on stamp paper of the right value, sign with two witnesses and, where your state requires it, register. Read every clause, change what doesn't fit, and ask a lawyer if anything is unusual. It is not legal advice.
